Please give me some information on my husband case

Hi my name is Jessica and I am married. My husband name is Odilon Sobrinho we have 2 United States born children. We been married for a little over 3 years now. Our son Davin is 4 and our daughter Maria is about to turn 3. My husband Odilon is not a U.S citizen he is a Brazilian citizen. Let me make this as short as possible...In 2006 my husband and I were driving from plattsburgh Ny to come to Massachuetts to visit family and on interstate 87 they had a check point set up. There he got caught by the border patrol. which was like a catch and release.

What can I do to help my friend who is in the U.S. illegally and has been detained by law enforcement?

Unfortunately, there is probably not a lot you can do to help him. When a person enters the country illegally and stays for more than 1 year they are banned from returning to the country for 10 years. Even if this person had a lawful means to immigrate to this country (i.e. close relative who is U.S. Citizen) he would have trouble because of his unlawful presence in the U.S. and because he is now in removal proceedings.

Why the 3/10 year bar encourages illegal immigrants to stay and does not act as a deterrant

The 3/10 year bar is the greatest paradox of American immigration law. The 3/10 year bar is a immigration law that says that anyone who enters the country illegally and without inspection by a U.S. immigration official and stays for 6 months is banned from returning for 3 years. If the persons who enters illegally and stays for 1 year then the person is barred from returning for 10 years. The law was passed in 1996 with the intent of "deterring" immigrants from entering the U.S. illegally.
