Filing I-130 on B1 Visa

I am a U.S. citizen married to an Ecuadorian. We married in the U.S. while she was on a B1 visa. She has since returned to her country. Her B1 visa is valid for 2 more years. If she comes back to the U.S. to visit (legally with her B1 visa) can I file her I-130 and I-485 while she is in the states?

i have applied for adjustment of status. i had my biometrics taken in January. My initial interview was in April with a follow up interview in May where additional documents were presented. Since then i have heard nothing.I then enquired and was told that they are awaiting law enforcement checks. Which checks are these and why have they taken sooo long since i am confident i have not committed any crime.

Hi my name is Jessica and I am married. My husband name is Odilon Sobrinho we have 2 United States born children. We been married for a little over 3 years now. Our son Davin is 4 and our daughter Maria is about to turn 3. My husband Odilon is not a U.S citizen he is a Brazilian citizen. Let me make this as short as possible...In 2006 my husband and I were driving from plattsburgh Ny to come to Massachuetts to visit family and on interstate 87 they had a check point set up. There he got caught by the border patrol. which was like a catch and release.
