USCIS Revises Policy On Background Checks

There has been a significant backlog and delay in the processing of petitions for adjustment of status because of delays in the processing of FBI background checks for prospective immigrants. This has left many intending immigrants and there family members in limbo for even longer than usual. The FBI background check has been a standard component of the immigration process for a long time and has not always created such a long delay. However, the dramatic increase in the USCIS filing fees in July 2007 created a surge of case filings because everyone wanted to file with the lower fees.

ACLU Sues State of Michigan Over Denial of Driver's Licenses to Non-U.S. Citizens

It has been rather standard procedure for many of the border states to attempt to end-run around the federal immigration laws and deal with localized immigration problems (real or perceived) with state law. Recently, Michigan (not a usual suspect) has taken a hard line against immigrants by using an existing section of the Michigan Motor Vehicle Code to deny driver's licenses to non-U.S. Citizens or lawful permanent residents. Utilizing a misguided interpretation of the Michigan Attorney General's published legal opinion regarding the definition of the term "resident" in the motor vehicle code, Land has instructed her office to deny driver's licenses to all Michigan residents who are not U.S. Citizens or lawful permanent residents.

“This site is something we’ve been thinking about doing for a long time and we felt that there really was not much out there that offered comprehensive information about U.S. immigration law system,” said Philip C. Curtis, immigration attorney and co-owner of E-Commerce Enterprises, LLC the company which operates the site. VisaAmigo.com is an informational website that focuses on family-based immigration issues. The site features numerous articles on immigration law topics, user forums, and free guides which provide step-by-step instructions for various immigration processes.

Why the 3/10 year bar encourages illegal immigrants to stay and does not act as a deterrant

The 3/10 year bar is the greatest paradox of American immigration law. The 3/10 year bar is a immigration law that says that anyone who enters the country illegally and without inspection by a U.S. immigration official and stays for 6 months is banned from returning for 3 years. If the persons who enters illegally and stays for 1 year then the person is barred from returning for 10 years. The law was passed in 1996 with the intent of "deterring" immigrants from entering the U.S. illegally.

What is conditional lawful permanent residency?

Conditional residency is essentially a probationary period for new lawful permanent residents who obtain their residency through marriage to a U.S. Citizen. When a U.S. Citizen and a foreign national are married the foreign national is entitled to apply for lawful permanent resident status in the U.S. If the foreign national applies and his or her petition is granted the USCIS will grant the applicant a 2 year conditional residency.

U.S. District Court Strikes Down Local Ordinance Against Illegal Aliens

Judge Munley of the U.S. District Court for the Middle District of Pennsylvania ruled yesterday that a local ordinance, known as the Illegal Immigrant Relief Act Ordinance, regulating the presence and employment of illegal aliens was unconstitutional. The City of Hazelton also passed the Tenant Registration Ordinance which required all persons living in apartments to obtain an occupancy permit. In order to obtain an occupancy permit under the ordinance an applicant had to present proof of U.S. Citizenship or lawful permanent residency.

U.S. Senate Rejects Negative Immigration Amendment

On July 25, 2007 the Senate rejected a harsh immigration enforcement amendment proposed by Senator Lindsey Graham (R-SC) to the Department of Homeland Security Appropriations Act (S. 1644/H.R. 2638).

The Graham amendment proposed a broad array of costly, counterproductive, and pernicious provisions. If passed, the amendment would have:
