Please give me some information on my husband case

Hi my name is Jessica and I am married. My husband name is Odilon Sobrinho we have 2 United States born children. We been married for a little over 3 years now. Our son Davin is 4 and our daughter Maria is about to turn 3. My husband Odilon is not a U.S citizen he is a Brazilian citizen. Let me make this as short as possible...In 2006 my husband and I were driving from plattsburgh Ny to come to Massachuetts to visit family and on interstate 87 they had a check point set up. There he got caught by the border patrol. which was like a catch and release. They took him into custody and then released him as long as he promised to show up for his court date. My husband and I went to his court date it was in June of 2006 and it got continued and we went back a couple more times. the last time that we had gone to court was in November of 2008 and the judge denied him adjustment of status here in the US, denied him voluntary departure, and ordered him to be removed from this country and back to brazil. It is now April 2009 and we have heard nothing from them about when he has to go back.. I was wondering if there is anyway he could be able to stay here with out going back to brazil or if when they do send him back if he can come back before the 10 years because apparently there is a law saying if u cross the border illegally than u cant enter back for 10 years...If you can help me in any way please let me know....we had a lawyer from buffalo Ny but we can no longer afford him he wanted alot more money to continue this case and no guarentee about winning the case....Please give me so information about how long he will be able to stay here with us and if he can apply for his visa right aways and be able to come back right away as soon as he gets back to brazil...any information on this subject would help me out so much......Thank you and i will be waiting to here from u.....
