3. Preparing the Adjustment of Status Petition for Filing

This section provides step-by-step instructions for putting the adjustment of status petition package together for submission to the USCIS.

*NOTE: Visa Amigo strongly recommends that all mail sent to the USCIS be sent via overnight mail so that it will arrive quickly, can be tracked, and delivery confirmation obtained. If you decide to use the U.S. Postal Service be sure to request a delivery receipt.

1. Prepare an envelope or shipping label addressed to:

For private couriers (non-USPS) deliveries:

2. In the envelop, include the following (in this order):

a. USCIS Adjustment of Status Cover Letter

b. Form I-485. Double check to be sure the form is completed and signed.

c. Form I-130

d.Form G-325A for Petitioner. Make sure all 4 copies are completed and signed at the bottom where indicated.

e. Form G-325A for Beneficiary. Make sure all 4 copies are completed and signed at the bottom where indicated.

f. Form I-864.

g. Form I-765. *This is optional.

h. Form I-131. *This is optional.

i. Passport Photographs. 2 each for you and your fiance. Make sure to print the name and date of the subject of the photograph on the back of each picture.

j. All of the other supporting documentation listed in the previous section and in cover letter.

3. Prepare a check made payable to the USCIS in the appropriate amount according to the attached fee schedule.

4. Make 3 photocopies of the entire petition and supporting documentation.

5. Attach all the supporting documents in paragraph with a paper clip in the order indicated with the check on top.

6. Mail the original copy of the petition to the USCIS.

7. Place the two additional copies in a safe place for your records.
