1. Collection of Supporting Documentation
The first step in the adjustment of status process in the collection of the required supporting documentation. You must submit the following supporting documentation with the adjustment of status petition:
1. Proof of Petitioner's U.S. Citizenship. Photocopy of your passport, birth certificate, or certificate of naturalization. *NOTE: If you use provide your passport as proof of citizenship be sure to copy all pages of the passport (even the blank pages.)
2. Marriage Certificate. Photocopy of your marriage certificate.
3. Proof of Termination of Prior Marriages. If you or your fiance were previously married you will need to provide certified copies of the judgment or decree of divorce which terminated any previous marriages.
4. Evidence of Fiance's Citizenship. Photocopy of your fiance's entire passport (including all blank pages.)
5. Form I-94. This is the form your fiance was given by the U.S. customs officials when she entered the U.S. Typically, this will have been stapled to a page in her passport. You will need to provide a photocopy of this document. We have attached a sample I-94 attached below for your reference.
6. Children of Fiance. If your fiance has children who came with her to the U.S. you will need to provide copies of the children's passports and birth certificates. The birth certificates are required to evidence that they are the children of your fiance.
7. Photographs. Two passport style photographs of you, your fiance, and his children, if any. The specifications for these photographs are the same as the photographs you provided with your initial petition. Be sure to print the name of the subject of the photograph on the back of each picture.
8. I-129 Approval Notice. Provide a copy of the I-129 approval notice you received from the USCIS when you filed the initial petition.
9. Bank Letter. The letter must indicate:
a. Date account opened;
b. Total amount deposited in the previous year; and
c. Current balance.
10. Employer Letter. The letter must be on company letterhead and indicate the following:
a. Date of Employment;
b. Nature of Employment (what is your job or position.); and
c. Whether the position is temporary or permanent. (*Permanent does not mean that the employer agrees to employ you for any specific period—it just means that the employment isn’t for a specified time that will definitely end.)
*NOTE: If you are self-employed you only need to provide your last years tax return and a copy of a business report from a commercial rating firm such as Dunn & Bradstreet. (*If such a report is not available for you or your company just indicate this in your cover letter.)
11. Investment Statements. Copies of most recent statements of all your investment accounts including 401K, IRA, mutual funds, simple investment account, or other similar investment accounts.
12. Tax Returns. Copies of your tax return for the last 2 years.
13. USCIS Cover Letter. Prepare form letter which is attached below.
