STEP 10: Adjustment of Status

After you and your fiance are married you must file a second petition with the USCIS to adjust the status of your fiance from a non-immigrant K1 visa holder to that of a lawful permanent resident. Until this process is completed your fiance does not have legal authorization to remain in the United States.

Although it is important to apply for adjustment of status as soon as possible after your marriage, your fiance will not be in jeopardy or in unlawful status as long as you were married within 90 days of the date your fiance entered the U.S.
