Understanding Social Security Card Issues for Immigrants

Many immigrants have questions about the rules and regulations related to social security cards. This area of law is somewhat complicated by the fact that there are two types of social security cards, and the similar Individual Taxpayer Identification Number or ITIN.

The Social Security Administration (SSA) will issue social security cards to U.S. Citizens, Lawful Permanent Residents and other persons who are legally authorized to work in the U.S. otherwise apply for a social security card.

Sponsoring an Immigrant for Lawful Permanent Residency

In many cases, an applicant for lawful permanent residency in the U.S. must have a financial sponsor. This sponsor must complete and sign Form I-864 (Affidavit of Support) which essentially obligates the sponsor to reimburse the government in the event that the sponsored immigrant accepts any public benefits such as welfare.

Planning Ahead for Your Petition to Remove Conditions on Residency

When a person obtains their lawful permanent residency status through marriage to a U.S. Citizen their lawful permanent residency status is conditional for two years. Within 90 days before the expiration of the conditional lawful permanent resident card the LPR is required to file a petition to remove the conditions on his or her residency. Filing this petition and the petition process can be very easy if you plan ahead.
